These contract terms apply to the legal relationship between you and us, EUROBUS AG (hereinafter collectively referred to as the travel organizer), for package tours or individual services offered by us in our own name. For services provided by third parties such as package tours from other car companies, travel organizers, or individual services such as flight tickets, tickets, rental cars, hotel accommodations, you conclude the contract directly with these other companies, and we are not your contracting party.

1. Contract Conclusion, Traveling Companions, Payment

1.1 Your telephone, written, or personal registration is binding for you. The travel contract between you and us is concluded with the unconditional acceptance of your registration. If the person registering reserves for additional travel participants, they are liable for their contractual obligations (in particular the payment of the travel price) as well as for their own obligations. For travel arrangements from other travel organizers and flight tickets that are merely mediated to you by the travel organizer, their own contract and travel terms apply.

1.2 Our services are described in the service description in the brochure or travel announcement. Special requests are only part of the contract if they have been confirmed in writing and without reservation by the booking office. Unless otherwise noted in the travel announcement, services begin with coach trips from the departure point, and with flight trips from the airport in Switzerland.

1.3 Payment: The payment terms are noted on the travel confirmation. If the deposit or final payment is not made on time, we have the right to withdraw from the contract without compensation and to charge the cancellation costs according to section 2.2.

2. Changes to Bookings or Cancellation of the Trip by the Traveler

2.1 If you cancel your trip up to 61 days before the start of travel, we will charge a processing fee of CHF 100.- per person, maximum CHF 1,000.- per order, plus telephone and fax expenses. Processing fees are not covered by any cancellation cost insurance. If you withdraw from the trip later or wish changes according to section 2.1, we must charge the following cancellation costs as a percentage of the invoice total in addition to the processing fee:

Up to 61 days before departure no additional costs, deposits are not refunded.
60 - 46 days before departure 10% of the travel price
45 - 31 days before departure 40% of the travel price
30 –16 days before departure 50% of the travel price
15 - 0 days before departure 100% of the travel price

2.2 The deadline for calculating the periods is determined by the receipt of your written notice to us or the booking office; if received on weekends or public holidays, the next working day applies.

2.3 Replacement Persons: If you must cancel the trip, you can name a replacement traveler who will take the trip under the same conditions. If this replacement traveler enters into the contract, you and they are jointly and severally liable for payment of the entire travel price, processing fee, and any additional costs. The entry of the replacement person is permitted:

for trips within Switzerland until the start of travel

for trips in Europe and in countries without visa requirements up to 48 hours before the agreed departure

It is also a prerequisite that the companies involved in the trip (hotels, airlines, and bus companies) also accept this change, which may be difficult, especially during peak season, or may fail due to flight tariff regulations.

3. Entry Formalities

Swiss citizens need a valid ID card, valid passport, or visa for trips, depending on the country (different regulations can be found in the respective travel announcement). Citizens of other countries should provide their nationality when booking and inquire at the respective embassies. Travel participants are themselves responsible for complying with these regulations, obtaining, and carrying the necessary travel documents (such as passport, ID card, etc.). Please check your travel documents before departure for completeness and accuracy. If entry is denied to you due to incorrect or missing documents, the return travel costs are at your expense (section 10).

4. Program and Price Changes

4.1 Changes before contract conclusion: We expressly reserve the right to change brochure information, service descriptions, prices in brochures, and price lists before your booking. Should this be the case, your booking office will inform you of these changes before contract conclusion.

4.2 Price changes after contract conclusion: In exceptional cases, it may be necessary to increase the agreed price. Price increases may result from:

a) subsequent increases in transportation costs (including fuel surcharges);

b) newly introduced or increased government fees or charges (such as airport taxes, landing fees, road tolls), exchange rate changes, or

c) government-mandated price increases (e.g., value-added tax).
If the costs of these travel services increase, they can be passed on to you. The travel price increases accordingly. We will make the price increase no later than 22 days before the start of travel. If the price increase exceeds 10 percent, you have the rights mentioned in section 7.4.

4.3 Program changes, changes in transportation after your booking and before travel begins: We also reserve the right, in your interest, to change the travel program or individual agreed services (such as accommodation, mode of transport, means of transport, airlines, flight times, etc.) if force majeure or an event that could not be foreseen or prevented despite all due care requires it. We will endeavor to offer you equivalent replacement services. We will inform you as soon as possible of such changes and their impact on the price.

4.4 Your rights if the travel price is increased, program changes, or changes in transportation are made after contract conclusion: If the program change or change to individual agreed services results in a significant change to an essential contract point or if the price increase exceeds 10 percent, you have the following rights:

a) You can accept the contract change;

b) You can withdraw from the contract in writing within 5 days of receiving our notice, and you will receive the already paid travel price refunded immediately;

c) Or you can notify us in writing within 5 days of receiving our notice that you wish to participate in an equivalent replacement trip we propose. If you do not send us a notice according to letter b) or c), you agree to the price increase, program change, or change to individual agreed services (the 5-day deadline is met if you hand your notice to the Swiss Post on the 5th day).

5. Trip Cancellation

5.1 Group Size: Our trips require a minimum of 20 travelers. We reserve the right to cancel the trip no later than 22 days before the start of travel if this minimum is not reached. This period is 14 days for 2-, 3-, and 4-day trips, and 1 day for day trips.

5.2 Compelling Reasons: Should compelling reasons, such as force majeure, natural disasters, unrest, terror, strikes, government measures, epidemics, etc., significantly hinder or prevent the safe conduct of the trip, we will inform you of the trip cancellation as soon as possible.

5.3 In both cases, we will endeavor to offer you a solution. 

6. Program Changes, Service Failures During the Trip

If program changes must be made during the trip, we will endeavor to offer an equivalent replacement service/alternative. Should the program have an objective loss of value due to the change, we will compensate you for this. If unforeseen necessary program changes result in additional costs because an equivalent replacement service or equivalent return transportation option is not available through no fault of ours and the measure is taken in the objective interest of the customer, these additional costs are borne by the customer. During the trip, the customer has the right to withdraw only if a substantial part of the agreed services are not provided and no reasonable alternative is offered, or if the customer refuses the replacement service for important reasons.

7. Trip Termination by the Traveler

If you terminate the trip, the travel price cannot be refunded; any additional costs (e.g., return transport) are at your expense. - If you must terminate the trip for compelling reasons (illness, accident, etc.), our tour guide will help you organize your return journey. Only if you terminate the trip for compelling reasons will we refund you those services that do not burden us (less a reasonable processing fee).

8. If You Have a Complaint

8.1 If the trip does not meet the contractual agreement or you suffer damage, you are obligated to immediately report this defect or damage to our tour guide.

8.2 The tour guide will endeavor to provide a remedy within a reasonable time during the trip. If no remedy is provided, remedy is not possible, or it is insufficient, have the tour guide confirm in writing the defects or damage complained of and the failure to provide a remedy. However, the tour guide is not authorized to acknowledge any claims for damages or the like. - If you fail to make a complaint and obtain written confirmation, we cannot address your complaint after the trip ends, and you lose all rights against us.

8.3 How to assert your claim against the travel organizer: If you wish to assert defects, refunds, or claims for damages against us, you must submit your complaint to us in writing within 30 days after the actual end of the agreed trip. Your complaint must be accompanied by the confirmation from the tour guide and any evidence. If you do not assert your claims within 30 days after the actual end of the agreed trip, all your claims are forfeited and you lose all your rights.

9. Liability of the Travel Organizer

9.1 General: We will compensate you for the objective value of agreed services that were not provided or were poorly provided, or for damage suffered, insofar as it was not possible for the tour guide to provide an equivalent replacement service or remedy the damage on site and we or the service provider are at fault (subject to the following sections).

9.2 Liability Limitations, Liability Exclusions

9.2.1 International Agreements and National Laws: If international agreements and national laws contain limitations or exclusions of compensation for damages from non-performance or improper performance of the contract, we are liable only within the scope of these agreements and laws. International agreements, national laws with liability limitations or liability exclusions exist in particular in the transportation sector

9.2.2 Liability Exclusions: We are not liable to you if the non-performance or improper performance of the contract or the damage is attributable to the following causes:

a) to failures on your part before or during the trip;

b) to unforeseen or unavoidable failures of a third party not involved in the provision of the contractually agreed service;

c) to force majeure or an event that we, the intermediary, or the service provider could not foresee or prevent despite due care. For example: natural disasters, unrest, strikes, terror, government measures, epidemics, etc. In these cases, any liability for damages is excluded.

9.2.3 Personal Injury, Accidents, etc.: For personal injury, death, bodily injury, etc., resulting from non-performance or improper performance of the contract, we are liable only if the damages are caused by us or our service providers. Subject to liability limitations and liability exclusions in international agreements and national laws (section 12.2.1).

9.2.4 Other Damages (Property and Financial Damages, etc.): For other damages arising from non-performance or improper performance of the contract, we are liable only if we or a service provider caused the damage through fault; this liability is limited to a maximum of twice the travel price; subject to lower liability limits or liability exclusions in international agreements and national laws (section 12.2.1).

9.2.5 Valuables, Cash, Jewelry, Credit Cards, etc.: We expressly point out that you are yourself responsible for the safe storage of valuables, cash, jewelry, credit cards, photo and video equipment, etc. You must never leave these items unattended in an unguarded coach or elsewhere. - We are not liable for theft, loss, damage, or misuse.

9.2.6 Coach, Train, Flight Schedules: Even with careful trip organization, we cannot guarantee compliance with these schedules. Delays can occur, especially due to heavy traffic, congestion, accidents, airspace congestion, diversions, delayed border processing, etc. In all these cases, we are not liable. We strongly advise you to take possible delays into account when planning your trip.

9.3 Events During the Trip: Outside the agreed travel program, local events or excursions may be booked during the trip. It is not excluded that such events and excursions may involve risks. These events and excursions are not offered by us, and it is your own responsibility whether you wish to participate. We are not liable for proper contract performance or for any damages.

9.4 Extra-Contractual Liability: Extra-contractual liability is governed by the applicable legal provisions. For other damages (i.e., not personal injury), liability is in any case limited to twice the travel price, unless international agreements or national laws provide for lower liability limits or liability exclusions.

10. The Invalidity of Individual Provisions of the Travel Contract Does Not Lead to the Invalidity of the Entire Contract.

11. Applicable Law and Jurisdiction

11.1 The legal relationship between you and us is governed exclusively by Swiss law.
